Free Domain Names (1) About this Policy - effective on Jul 22nd, 2004 The purpose of this policy is to provide our customers with a set of guidelines and schedules related to payment for services and other items provided by VSource. This policy contains rules, guidelines, and schedules that govern how payments are calculated, collected, posted, processed, refunded and/or credited. Your compliance with this policy and all rules, guidelines, and schedules contained herein is a prerequisite for the use of any services and/or items provided by VSource in which payment is required. Your continued use of such services and/or items constitutes your agreement to these terms in whole as well as your acceptance of any penalties and/or fees that may arise due to the failure to comply with these terms. Back to top (2) Policy Changes - effective on Jul 22nd, 2004 We reserve the right to make changes to this policy at any time and without any advance notice as to protect the interests of our company, our clients or their end customers, our partners, our resellers, our distributors, or our affiliates. All changes to this policy will be posted on this web site and shall become effective on the day of the posting. All current clients shall be notified via email of a change to this policy on the day of the change. Clients who do not agree to the changes made to this policy shall have a grace period of not more than 10 days to cancel their services or product licenses with VSource Software before having to comply with those changes. Any use of our products or services beyond the 10 day grace period constitutes your agreement to any changes or additions made to this policy. Back to top (3) Price Changes - effective on Jul 22nd, 2004 We reserve the right to make changes to any of our prices for any items or services we provide at any time as to meet the ever changing demands of the economy. Upon a price change we will give 30 days advance notice to those customers affected by the price change via email notification as well as messages posted on our web site. Your continued use of provided services and/or items beyond the 30 day grace period constitutes your agreement in whole to these price changes as well as your agreement to allow us to charge your account in accordance with the new pricing. Back to top (4) Payment Options - effective date Mar 22nd, 2006 Upon signup, all customers may wish to provide credit card information as a primary method of payment. However, we do also accept personal and business checks as well as money orders and payments by PayPal as payment for applicable fees and items we sell online. To pay by check or money order, simply send us your payment and we will credit your account as soon as the check or money order clears and funds are deposited into our account. Any time we bill your account or a purchase is made, we will use up any credit on your account before attempting to charge your credit card. So essentially, if you wanted to pay solely via check or money order, all you have to do is keep sending us payments so that your account is credited prior to your billing date. To make payments via check or money order, please send payments to: VSource Corporation ATTN: Billing Department 500 4th St. NW STE 210 Albuquerque, NM 87102 Please make sure to include your Account Number and Invoice Number (if you have an invoice number) on your check or money order. Your account number can be found by clicking on the My Profile button in the members control panel. If you have any special instructions on how the funds should be used, please include those instructions in typed format with a printed name and signature. Back to top (5) Account Credits - effective on Jul 22nd, 2004 Each time a billing occurs or a purchase is made online, the system will use up any credit on an account before it will attempt to charge the credit card on that account. If the amount of credit on the account exceeds the amount of the bill, the credit card will not be charged and the credit will debited from the account credit balance. If the amount of credit on the account is less than the amount of the bill, then the credit card will be charged for the remainder to satisfy the bill. In the event that the bill cannot be satisfied in full by any means available, no account credit deduction will occur and the entire amount of the bill will be considered unpaid. To place a credit on your account, you must either send a check or money order to us using the address above for the amount of the credit you wish to place on your account or you must be eligible to receive a credit based on a current promotion. Back to top (6) Billing Schedule - effective on Jul 22nd, 2004 All recurring billing items will have a set date that billing starts. On the billing start date the first billing will occur. Billing will continue on the set schedule until the billing is cancelled by the user or the account is removed due to nonpayment. In the event that billing fails, the user will have no more than 15 days to remedy the problem before the item or licensing is disabled. In the event that an item becomes disabled, a $10 late fee may be charged to the user's account. If a product or service is disabled, any data contained therein may not be accessible except by means of repayment and reactivation of the product license or item. You are solely responsible for keeping up to date backups of your information, site files, databases, emails, and settings in the event that your product is disabled due to nonpayment. By using any VSource provided products or services you agree to release us from all liability due to any data loss if your product becomes disabled for any reason. Back to top (7) Issuing Refunds - effective on Jul 22nd, 2004 Fees for services or items we provide are non-refundable unless otherwise stated on our site. We do offer a 30-day money-back satisfaction guarantee. If you are unsatisfied with our products or services within the first 30 days, we will refund your money and cancel your transaction with us. More about the 30 day money back guarantee is stated below. Fees for the purchase of some items are non-refundable and are therefore exempt from the 30 day money back guarantee. Such items will have proper notices stating that there are no refunds for said items, no exceptions. In the event that a refund is issued, we will simply issue a credit to the credit card used for the purchase. If a credit card was not used for the purchase, we will send a check to the billing address on the account within 10 business days. Back to top (8) 30 Day Money Back Guarantee - effective on Jul 22nd, 2004 If at any time during the first 30 days of service you are not satisfied for any reason, we will refund your money for your item and cancel your transaction. You may be required to provide proof that you are not still using the product or service before we can issue a refund. There is a limit 1 lifetime refund per customer or organization. If you do decide to receive your refund based on this 30 day money back guarantee, you will not be able to use it again, even if you purchase a different product or service. This offer is non-transferable and not valid with any other offer or promotion. Some products or services that we offer are exempt from this guarantee and as such are non-refundable. Such items will have proper notices stating that there are no refunds. Back to top (9) Additional Fees - effective date Jul 22nd, 2004 VSource reserves the right to collect any additional fees due to non-payment, or the violation of any posted VSource Policies via any means necessary including but not limited to charging your credit card for such fees. VSource also reserves the right to determine at our sole discretion the amount of such fees as to recover any losses due to any damages, liabilities, disputes, or other events resulting in losses to VSource Corporation, its clients or their end users, its partners, its subsidiaries, its resellers, its distributors, or its affiliates, which are directly or indirectly related to your actions on this site or by use of VSource provided products or services in whole or in part and without limitation. Back to top (10) Free Domain Names - effective date May 30th, 2005 This section only applies if you received a Free Domain Name through our Free Domain Name Promotion. (This promotion only applies to .com and .net domain names) The Domain Name is provided for Web Hosting Purposes for 1 Year Free of Charge. At the end of 1 year, you will be required to pay for Domain Name Renewal at the then regular price. If you do not, the domain name will expire and you will lose all rights to the domain name. Please note that Auto Renew is turned on by default so 30 days prior to expiration we will attempt to renew it automatically. If you do not want to pay for Domain Name Renewal at the end of 1 year, you must turn the Auto Renew Feature off through the Members Control Panel. Renewal fees are non refundable. During the 1st year, the Domain Name cannot be transferred or managed. If at any time during the first year you wish to manage or transfer it, you must purchase it at regular price through the Members Control Panel. To purchase the domain name within the first year, login to the Members Area, click on the Domain Names Button, find your domain name and click on the red $ icon on the right side of the screen. (All Domain Name Registration Transfer and Renewal fees are non refundable.) |
